Rules for the Instagram Contest “Plein Fatale Rose”

 

  • 1 General Provisions
  1. The Competition is organised by Beauty Boutique sp. z o. o. with its registered office at ul. Kosmatki 12, identified by its NIP number 1132463200, REGON number 015656619, KRS number 0000196904, share capital PLN 50,000, hereinafter referred to as the "Organiser".
  2. The Competition is conducted according to the principles described in these Regulations in accordance with the generally applicable provisions of Polish law.
  3. The competition begins on 16.05.2024 at 16:00 and ends on 31.05.2024 at 23:59:59 Polish time.
  • 2. Participants and Rules of the Contest
  1. Participation in the Competition is voluntary and free of charge.
  2. The Competition is open to a natural person (consumer within the meaning of Art. 22 of the Civil Code), hereinafter referred to as the Participant, who:
    1. has read these Regulations and accepted their content and has consented to the processing of personal data for the purpose of conducting the Competition by registering for participation in the Competition;
    2. is over 13 years of age and has full legal capacity;
    3. having a delivery address in the territory of the Republic of Poland,
    4. has a public account (profile) on Instagram,
    5. complete the Competition Task.
  3. Only a person who meets the conditions specified in §2. paragraph 2 may participate in the Competition.
  4. The Organizer's employees and entities and employees of entities providing services to the Organizer when organizing the Competition on the basis of civil law contracts are excluded from participating in the Competition, as well as members of the immediate family (spouses, ascendants, descendants and siblings) of the above-mentioned persons.
  5. In order to participate in the Competition, during its duration, the Participant will complete the Competition Task consisting of:

▫️Write a comment under the post

(hereinafter referred to as the Competition Task).

  1. Only Participants who complete the Competition Task during the Competition will take part in the Competition.
  2. A Participant may take part in the Competition only 1 (in words: one) time.
  3. The Organizer reserves the right to remove and not include in the Competition completed Contest Tasks whose authors:
  4. a) they do not act on their own behalf, but through third parties,
  5. b) operate from fictitious Instagram accounts/profiles;
  6. c) create fictitious Instagram accounts/profiles;
  7. d) violates Instagram's terms and conditions.
  8. e) used in the Contest Task words generally considered offensive, pornographic content, content promoting hatred on racial, ethnic or religious grounds or discriminating against social groups, violated the personal rights of third parties or persons or the Organizer.

  • 3. Rights to completed Contest Tasks
  1. The Participant guarantees that the completed Contest Task will not violate any rights or goods of the Organizer, third parties and entities, in particular their property and personal copyrights and personal rights.
  2. The Participant declares that he/she has exclusive and unlimited copyright to the completed Contest Task and that the completed Contest Task is not encumbered with any third party rights and the work has not been previously published.
  3. Pursuant to art. 921 § 3 of the Civil Code, the Organizer reserves, upon issuing the Prize, the acquisition of a non-exclusive license to the awarded Contest Task without time and territorial limits, and the awarded Contest Participant (Winner) grants the Organizer a non-exclusive license to the awarded Contest Task in the following fields of exploitation:
    1. in the scope of recording and reproducing the work - producing copies of the work using a specific technique, including printing, reprographic, magnetic recording and digital technology;
    2. in the scope of circulation of the original or copies on which the work was fixed - introduction to circulation, lending or rental of the original or copies;
    3. with regard to disseminating the work in a manner other than that specified in point b - public performance, exhibition, display, reproduction and broadcasting and re-broadcasting, as well as making the work publicly available in such a way that everyone can have access to it at a place and time of their choosing, including entering the work into computer memory and telecommunications and IT networks.
  • 4. Prizes and selection of the Winners
  1. In order to ensure the proper conduct of the Competition, the Organizer will appoint a 3-person Commission, hereinafter referred to as the Competition Commission. The tasks of the Competition Commission will include overseeing the proper conduct of the Competition, making decisions on all matters concerning the Competition, including the interpretation of the provisions of these Regulations and selecting Participants who will be awarded the Prizes (hereinafter referred to as the Winners). The Commission's decisions are final, which does not deprive the Participant of the right to pursue claims arising from the provisions of the law.
  2. After the end of the Competition, the Competition Committee will evaluate the Competition Tasks performed by the Participants and select 3 (in words: three) Winners among the Participants who, in the opinion of the Competition Committee, will perform the Competition Task in the most attractive, original and creative way.
  3. The following prizes will be awarded to the Competition winners:
    1. place – Plein Fatale Rose fragrance 90 ml

    2. place - Plein Fatale Rose fragrance 90 ml

    3. place - Plein Fatale Rose fragrance 90 ml

  4. The prizes are exempt from personal income tax pursuant to Article 21 section 1 item 68 of the Personal Income Tax Act.
  5. The Committee will complete the selection of Winners no later than 3 May 2024.
  6. The Winners of the Competition will be informed about receiving the Prize by posting a list of Winners indicating the names of their profiles (accounts) on the Organizer's profile on Instagram @beautyboutique no later than 4.06.2024.
  7. Information about winning the Competition will be sent to the Winners in a private message on Instagram.
  8. The condition for receiving the Prize is that the Winner sends an e-mail to the Organizer within 14 days from the date of sending the Prize by the Organizer to the following address: biuro@beautyboutique.pl information necessary to deliver the Prize, including in particular: first name, last name, e-mail address and correspondence address in the territory of the Republic of Poland.
  9. If the Winner fails to provide the data necessary to deliver the Prize within the time limit and in accordance with the principles specified in section 7 above, the Competition Committee will select another Participant to receive the Prize.
  10. The Organiser shall not be liable for failure to deliver the Prize to the Participant if the impossibility of delivering the Prize resulted solely from the Participant’s failure to provide the data required for delivery of the Prize or providing incorrect data or data inconsistent with the Rules.
  11. Each Prize will be sent once by the Organizer to the address indicated by the Winner in the territory of the Republic of Poland within 7 days from the date of sending by the Winner, in response to the information notifying about the awarded Prize, all data enabling the shipment of the Prize.
  12. The Prizes are sponsored by the Organizer.
  13. The winner may not transfer the right to the prize to a third party.
  14. The Winner may waive the right to the Prize awarded to him/her by submitting an appropriate written statement to the Organizer.
  15. In the Competition you can receive the Prize only 1 (in words: one) time/more than 1 (in words: one) time.
  16. The prize will be sent to the Participant at the Organizer's expense.
  17. The Participant has no right to request an exchange of the Prize for a cash prize.

 

 

  • 5. Personal Data
    1. The administrator of the personal data of the Participants is the Organizer. Contact with the organizer is possible by correspondence to the correspondence address Kosmatki 12 03-982 Warsaw and to the e-mail address biuro@beautyboutique.pl
    2. The basis for the processing of personal data is Article 6 paragraph 1 letter a of the GDPR, the consent of the Participants to participate in the Contest and Article 6 paragraph 1 letter f, i.e. the legitimate interest of the administrator, in particular in the scope of considering complaints and pursuing claims.
    3. The personal data of the Participants will be processed to the extent and for the purpose necessary to conduct the Competition, select the Winners, consider any complaints and, in the case of the Winners, also notify them of the awarding of the Prize and issue the Prize.
    4. Providing personal data is voluntary, but is a condition for issuing Prizes to Winners or submitting a complaint regarding identification and address data.
    5. Personal data will be stored for the duration of the Competition, and after its end until the statute of limitations for any claims has expired or the obligation to store data resulting from legal provisions has expired, but no longer than for 5 years from the end of the calendar year in which the Competition was held.
    6. The Organizer implements the rights of data subjects, i.e. access to the content of their data and the right to rectify, delete, limit their processing, the right to transfer data.
    7. In the case of processing personal data based on consent, the Participant has the right to withdraw consent at any time, and the withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. Withdrawal of consent requires electronic notification to the e-mail address biuro@beautyboutique.pl
    8. The recipients of the data are: entities providing hosting services, postal services, entities with which the Organizer cooperates within the framework of accounting and tax services, public authorities on the basis and within the limits of the law, in particular the National Tax Administration, law enforcement authorities.
    9. Personal data are not processed automatically and are not subject to profiling.
  • 6. Complaints
    1. The Contest Participants have the right to submit a written complaint with the note "Complaint: "PLEIN FATALE ROSE CONTEST" to the following address: e-mail biuro@beautyboutique.pl or the correspondence address of the Organizer Kosmatki 12, 03-982 Warsaw related to the course of the Competition during its duration, as well as up to 7 days after the end of the Competition.
    2. The letter containing the complaint should indicate the name and surname of the Participant and the correspondence address to which the response to the complaint will be sent.
    3. The Organizer will respond to the complaint to the Participant within 14 days by registered mail sent to the address provided in the letter containing the complaint.
    4. A negative consideration of the Participant’s complaint by the Organiser does not exclude the Participant’s right to pursue claims to which he or she is entitled under generally applicable provisions of law, including through court proceedings.

 

  • 7. Final provisions and technical information.
  1. The regulations enter into force on 16/05/2024.
  2. The Competition is not a promotional lottery within the meaning of Art. 2 sec. 1 item 9 of the Act on Games and Mutual Wagering of 29 July 1992 (Journal of Laws of 2004, No. 4, item 27, as amended) and is not subject to the rules contained in the aforementioned Act and implementing regulations to this Act.
  3. The Competition Organizer is not responsible for the inability of a potential Participant to submit the completed Competition Task due to reasons attributable solely to the Participant.
  4. The Competition Rules are available during the Competition via the public Internet network at the URL address: https://beautyboutique.pl/ and at the Organizer's office.
  5. The Organizer undertakes to make every effort to amicably settle any disputes that may arise in connection with the conduct of the Competition.
  6. The court with jurisdiction to resolve disputes is the court with local and subject-matter jurisdiction in accordance with the law.
  7. This Contest is in no way sponsored, administered or endorsed by, or associated with, Instagram.
  8. The entity solely responsible for conducting the Contest is the Organizer, and Participants agree to release Instagram from any liability that may arise in connection with organizing the Contest.

Any change to the Regulations requires the publication and notification of Participants about the changes made by the Organizer. Changes may be made only for the purposes of adapting the Regulations to the standards of applicable law.

  7. Information about winning the Competition will be sent to the Winners in a private message on Instagram.
  8. The condition for receiving the Prize is that the Winner sends an e-mail to the Organizer within 14 days from the date of sending the Prize by the Organizer to the following address: biuro@beautyboutique.pl information necessary to deliver the Prize, including in particular: first name, last name, e-mail address and correspondence address in the territory of the Republic of Poland.
  9. If the Winner fails to provide the data necessary to deliver the Prize within the time limit and in accordance with the principles specified in section 7 above, the Competition Committee will select another Participant to receive the Prize.
  10.
